Atlas Common Terms of Service

General Provisions

These Atlas Common Terms of Service (hereinafter referred to as the “Terms”) will commonly apply to all users of the services (hereinafter collectively referred to as the “Atlas Services”; the matters that are currently subject to services are stated in the clauses of the Atlas Services) provided by Atlas Co., Ltd. (hereinafter referred to as “Atlas”). Users shall agree to the Terms in advance and then may use the Atlas Services. Besides the Terms, individual terms and conditions, guidelines, and policies may be added to each individual service for the use of the Atlas Services. Please check before using each service. Individual terms and conditions, guidelines, and policies constitute a part of the Terms. In addition, the Atlas Services Use Agreement concluded between Atlas and the user shall consist of the Terms, individual terms and conditions, guidelines, and policies.

The Atlas Services

  • Confit This is a service provided by Atlas that supports the operation of academic conferences, exhibitions, and the different types of events (hereinafter referred to as “Events”). (Confit Terms of Service)

Terms of Service (Common)

Article 1 Definitions

  1. “User” of the Atlas Services is the general term for a registered user who has submitted registration based on the Terms or a guest user.
  1. “Registered user” shall mean an individual who uses the Atlas Services, and the term shall refer to a user who has entered the necessary information on the form for user registration and sent it and for whom Atlas has given approval, or a user for whom user registration for the Atlas Services as conducted by a manager or by an organizer of an academic conference or exhibition. A registered user can use the Atlas Services within the different scope set forth by Atlas, a manager, or an organizer for each individual registered user.
  1. “Guest user” shall refer to an individual who uses the Atlas Services within the scope in which use is possible without submitting the user registration stipulated in the preceding clause.
  1. “Intellectual property rights” shall mean copyrights (including the rights stipulated in Article 27 and Article 28 of the Copyright Act), patent rights, utility model rights, trademark rights, design rights, and other intellectual property rights (including the rights to obtain those rights or apply for registration of those rights).
  1. “Submitted data” shall mean the content (including but not limited to texts, images, videos, and other data) that a registered user submits or otherwise sends by using the Atlas Services.
  1. “Agreement party” shall refer to a corporation, group, organization, or individual that has applied for the Atlas Services and used the method separately designated by Atlas to conclude a service use agreement in relation to the Atlas Services.
  1. “Organizer” shall refer to a corporation, group, organization, or individual that will provide, in the Atlas Services, operational support for an academic conference, exhibition, or any type of Event.
  1. “Manager user” shall refer to a user who the agreement party designated at the time of application for the Atlas Services and who has been given the authority of a manager by Atlas, or to a user who has been given the authority of a manager by another manager user by the method permitted and designated by Atlas and who will use the management functions of the Atlas Services.

Article 2 Registration

  1. A user who wants to use the Atlas Services can agree to respect the Terms, use the method stipulated by Atlas to provide certain information stipulated by Atlas (hereinafter referred to as the “Registration Information”), and thereby submit an application to Atlas as registration for the use of the Atlas Services.
  1. When Atlas has received an application as registration for use and has approved that application, it will issue an account for the Atlas Services.

Article 3 Management of the ID and password

  1. The registered user shall be liable for the management and storage of the e-mail address and password necessary for use of the Atlas Services, and even in the event of the theft, loss, wrongful use, or unauthorized use by a third party, Atlas shall not bear any liability whatsoever for damage caused by such event.
  1. In the event of any change in the Registration Information, the registered user shall follow Atlas’s prescribed method to promptly notify Atlas of the changed information.
  1. Even if the registered user incurs a disadvantage for failing to issue the notification of the preceding clause, Atlas shall not bear any liability whatsoever for that disadvantage.
  1. The registered user cannot loan or transfer the account, change the name of the account, sell the account, nor allow a third party to use the account.
  1. Any use of these services via the e-mail address and password as necessary for use of the account, irrespective of the reason, such as theft, loss, wrongful use, or unauthorized use by a third party, that use will be deemed to be use by the registered user.

Article 4 About account deletion

If the user wants to delete the account, the user can do so for these services through the account deletion function from the registered user’s account settings.

Article 5 Cancellation of registration

If the registered user meets any of the conditions below, Atlas can, without issuing a notification or making a demand in advance, delete the submitted information, temporarily suspend the use of the Atlas Services for that registered user, cancel registration as a registered user, or cancel the service use agreement. Even if damage arises for the registered user in association with the suspension of the use of the Atlas Services, cancellation of registration, or cancellation of the service use agreement based on this article, Atlas shall not bear any liability whatsoever for such damage.
  1. When the registered user violated any clause of the Terms
  1. When there is no reply to an inquiry or other contact from Atlas requesting a reply for a period of thirty days or longer
  1. When Atlas has otherwise judged that the use of the Atlas Services, registration as a registered user, or continuation of the service use agreement is not appropriate

Article 6 About the data and personal information that will be collected

  1. Atlas shall appropriately manage personal information based on the Personal Information Protection Policy.
  1. For the purpose of providing the Atlas Services, Atlas will share the personal information of users to the business operators consigned by Atlas and that have concluded a confidentiality agreement.
  1. The personal information of users will not be disclosed without the user’s agreement to parties other than cooperating companies that have concluded a confidentiality agreement. Provided, however, that personal information may be disclosed in the following cases:
    1. When Atlas has reasonably judged that disclosure is necessary based on a law or regulation
    2. When disclosure is necessary for the purpose of protection of a person’s life, body, or property, and it is judged that obtaining the relevant person’s agreement is difficult
    3. When disclosure is particularly necessary for the purpose of improving public health or promoting the sound upbringing of children, and it is judged that obtaining the relevant person’s agreement is difficult
    4. When it is necessary to cooperate with a national government organization, a local government, or a party that received consignment from a national government organization or a local government executing clerical administration stipulated in a law or regulation, and it is judged that there is a possibility that obtaining the relevant person’s agreement will hinder the execution of that administration
    5. When the service entity has been changed because of a merger or another reason, and it is judged that it is necessary to transfer personal information for the purpose of continuation of service

Article 7 Copyrights and other intellectual property rights

  1. The texts, photographs, program content, and other intellectual property rights in an individual academic conference, exhibition, or event provided by the Atlas Services will attribute to the agreement party or the organizer of the individual academic conference, exhibition, or event. The editorial copyrights related to the Atlas site’s layout and design will attribute to Atlas. The user can use that information only for a personal purpose within the scope of use of the Atlas Services, and any reproduction, distribution, public transmission, or any other use of that information for a purpose other than the use of the Atlas Services shall be prohibited.
  1. For content (including but not limited to texts, images, videos, and other data) that is submitted or otherwise transmitted by using the Atlas Services, Atlas shall be able to make any changes, removal, or other modifications within the scope that is necessary for the smooth provision of the Atlas Services or for building, improvement, or maintenance of an Atlas system.

Article 8 Prohibitions

Upon the use of the Atlas Services, Atlas shall prohibit the following actions or potential actions as listed below:
  1. Violations of the Terms or a law or regulation
  1. Actions that violate public order or morals
  1. Any criminal activity or the promotion of a criminal act
  1. Defamation of Atlas, another user, or a third party or actions that cause a disadvantage to Atlas, another user, or a third party
  1. Infringement of the copyrights or other intellectual property rights of Atlas or a third party
  1. Infringements of the assets or privacy of Atlas or a third party
  1. False registration of information for the use of these services, including user registration procedures
  1. Wrongful use of an e-mail address or password
  1. Loaning or transferring one’s own or another registered user’s ID or password, changing the name of that ID or password, selling that ID or password, or allowing a third party to use that ID or password
  1. Impersonating another person
  1. Any attack on these services or intentionally placing a burden on the system of the Atlas Services
  1. Reverse engineering or other analysis of the software or another system provided by Atlas
  1. Wrongful actions of intentionally affecting the operation of the Atlas Services
  1. Actions for which monetary interests arise
  1. Providing advertisements, publicity, or solicitations to a third party without permission from Atlas
  1. Other actions judged inappropriate based on social conventions
  1. Other actions for which Atlas reasonably judges, based on reasonable grounds, that the actions are inappropriate as a user of the Atlas Services

Article 9 Suspension of Atlas Services

  1. In the event of any of the conditions listed below, Atlas shall be able to suspend or interrupt all or a portion of the Atlas Services without notifying the registered user in advance:
    1. When inspection or maintenance work for a computer system related to the Atlas Services will be regularly or urgently conducted
    2. When a computer or a communication line has stopped because of an accident
    3. When the operation of the Atlas Services has become impossible because of force majeure, such as a fire, a power outage, or a natural disaster
    4. When a problem, interruption, or suspension of the service, stoppage of collaboration with the Atlas Services, or a change in the specifications has arisen in an external linked service
    5. When Atlas has otherwise judged that suspension or interruption is necessary
  1. Atlas can stop the Atlas Services based on the circumstances of Atlas.
  1. Atlas will bear no liability whatsoever for any damage that arises for the user based on measures that Atlas implements based on this article.

Article 10 Disclaimer

Excluding cases of intention or gross negligence, Atlas shall not bear any liability to provide compensation for damage incurred by the user because of or in relation to the use of the Atlas Services.

Article 11 Changes of Terms

  1. In the cases below, Atlas shall be able to change the Terms at the discretion of Atlas:
    1. When the change of the Terms is suited to users’ general interests
    2. When the change of the Terms does not violate the purpose for which the use agreement for the Atlas Services was concluded, and when the change is reasonable in light of the need for the change, the reasonableness of the content after the change, the content of the change, and other circumstances related to the change
  1. For a change of the Terms, Atlas will use a method that Atlas recognizes as appropriate to notify users no later than two weeks before the effective date of the Terms after the change of the fact that the Terms will be changed, the content of the Terms after the change, and the effective date of the changed Terms.
  1. If Atlas has notified users of the content of the Terms after the change and a user has used the Atlas Services on or after the effective date of the changed Terms, Atlas will deem that the user agreed to the change of the Terms.

Article 12 Damage compensation

If the Terms are violated, Atlas will have the user provide compensation for any damage that arises for Atlas.

Article 13 Separability

Even if it is judged that any clause of the Terms or a portion of a clause of the Terms is invalid or unenforceable based on the Consumer Contract Act or another law or regulation, the remaining provisions of the Terms or the remaining portion of the provisions for which a portion was judged to be invalid or unenforceable shall continue and remain in full force and efficacy.

Article 14 Governing laws and jurisdiction

The laws of Japan will be the governing laws for the Atlas Services, and the Tokyo District Court or Tokyo Summary Court will be the court of exclusive jurisdiction in the first instance for all disputes that arise in relation to the Atlas Services.

Article 15 Resolution through discussion

If a matter that is not stipulated in the Terms or a question about the interpretation of the Terms arises, both parties shall discuss the matter by following the principles of good faith and sincerity and strive to promptly resolve the matter.

Terms of Service (Managers)

The agreement party or the organizer shall comply with the Terms of use as a manager user or a user, and the Terms, individual terms and conditions, guidelines, and policies shall comprise a part of the use agreement for these services. If a separate agreement that prevails over these terms has been made in a written agreement or application between Atlas and the agreement party or the organizer, the stipulations of that separate agreement will take precedence.

Article 1 Registration

  1. After concluding an agreement with Atlas, a manager user can agree to comply with the Terms and use the method stipulated by Atlas to provide certain information stipulated by Atlas (hereinafter referred to as the “Registration Information”) and thereby submit an application to Atlas for registration of the use of the management functions of the Atlas Services.
  1. After submitting an application, the manager user will be given the authority of a manager by Atlas and will be able to use the manager functions of the Atlas Services.
  1. The manager user shall bear an obligation to have users comply with the Terms and individual rules and shall manage that compliance with the care of a good manager.
  1. If the manager user will use the Atlas Services as a user, the said manager shall comply with these Terms of Service as well as the Terms that apply to users.

Terms of Service (Users)

Article 1 Registration

  1. A user who wants to use the Atlas Services shall agree to comply with the Terms and use the method stipulated by Atlas to provide certain information stipulated by Atlas (hereinafter referred to as the “Registration Information”) and thereby submit an application to Atlas for registration for the use of the Atlas Services.
  1. When an application for use registration is submitted, Atlas will issue an account for the Atlas Services.
  1. If  some user management functions rely on an external system, such as a member management system, it may become impossible to use the Atlas Services because of the external system’s service suspension or interruption or a change of specifications. The user shall use these services after consenting that Atlas will not bear liability to compensate for any damage that arises because of that. Atlas will also not guarantee anything related to external systems.
  1. If an organizer is limiting the user’s use of the Atlas Services, it will be possible to use the use permission authentication code for which the organizer gave notification or to use the Atlas Services by using the account that was registered by the organizer.
